Lowside and DEFINITELY totalled bike *UPDATES* (should I keep?)

I was coming around a fairly tight left-hand corner on my way home yesterday afternoon, speed limit is 30mph so I was doing about that, when some lady in a green subaru outback wagon (if you were from VT, you'd know...) decides it'd be prudent to pull out of a side street at the exit of the turn right as I was passing the apex. Didn't see me, listening to public radio too loud, whatever, but at that point I can either a.) smack into the back of her or b.) try to brake as best as possible... I take b, which results in the rear sliding out and me lowsiding in the middle of the curve. The bike slides out of the lane and smacks a big granite curb really hard, bouces back into the road. I slide on my back and am on my feet almost immediately (felt like less than a second) and give her the universal WHAT THE FUCK gesture...

damage: I was wearing FULL gear (mesh A* stunt jacket over a CF hoodie, velocity gear back armor, draggin kevlar pants, boots, carbon knuckle gloves, icon mainframe, etc.), so I only have a half-dollar sized burn on my elbow where the elbow armor didn't cover and the mesh got rashed through. Both knees got a little impact cuts and bruises, but the kevlar in the draggin camo pants saved me SOOO much rash on my left leg and butt. scraped the gloves and helmet a bit, nothing too serious.

the bike: rear wheel bent, chain off, frame might be fucked (right side frame slider is BENT downwards, I think from hitting the curb and landing in the road, it's an engine mount bolt too, so engine might be fucked), handlebars bent, brake lever bent, tank dented all over the place, tail light cracked, etc. general rash damage. nothing actually came off but my left bar-end mirror, which somehow (?) didn't break... anyway, insurance adjuster has to check it out but considering it's a '94, probably will be totaled. hope I can salvage parts from it at least.

anyway, I have witnesses and pictures, progressive is on the case and hopefully her insurance will pay out for everything (including my gear). The lady was really apologetic at first and said she didn't see me, but then started asking me 'well how far away do you really think you were, and how fast do you really think you were going'... trying to weasel out of it, seemed like.

anyway sorry about the long rant... yesterday sucked. FUCKING CAGERS

:wtf:Man ........I am glad that you are OK. You can fix bikes. That is so typical to try to blame it on you !!! that sucks !

jesus buddy. glad youre okay!! too bad about the bike....looks like someones gonna have a new project soon. or a new version of an old one.

dont know how it is in vermont but in NY they have this thing where they can split the fault. doesnt have to be totally one person. and since they can, they always do. they might try some shit like telling you that she had enough time to get into the lane so she didnt cut you off. fight the good fight, look up the stopping distance from 30 mph for your bike, figure out how much room you actually had.take pictures of the accident scene, and then be a persistent dick.....

I had a kid pull out in front of me while I was doing 60 in a pickup truck, but he was able to get turned and I hit him in the back so they tried to blame me. only wanted to give him like 70% of the responsibility. by arguing I got it up to 90%

glad you didn't get hurt too bad

if you did't actually hit her car she may not be held responable ,if you hit her car she could be responsable for not yeiding right of way but if she cuts you off and you miss her completely some times they just say sorry bout your bad luck

CRF3: I've never heard of anything like that around here. The officer in charge of the case was asking me whether it was more or less than $1000 worth of damage, as that's the cutoff for an accident report. The insurance company determines at-fault independently as well.

Rog: Hopefully I don't get screwed because I didn't hit her... I certainly COULD have, had I not braked and bailed, but that would have ended much worse!

here's hoping for some sort of compensation and not having to write off a 2000 dollar bike and 300 worth of gear. Thanks for the support guys!

hopefully not man. I was worried about the not hitting her thing too. well, at least you'll get her address through all this. and you just happen to know 1500 or so "random" people that could visit her car for $2k worth. see how the shoe feels on the other foot, scratched up and with broken mirrors...

Glad u didn't get hurt too bad bro, My son (banjaxed) just went thru that shit last month...but here in fl if a car is involved in an accident with a motorcycle the car is ALWAYS at fault...hope they take care of you
